January 17, 2018Our Foreclosure Unit recently enjoyed a noteworthy victory after winning a motion to dismiss in a foreclosure action on behalf of a disabled survivor of domestic violence. The bank claimed to have served our client by delivering the Summons and Complaint to her ex-husband’s residence, an address she’s never visited. Supreme Court found that the Plaintiff failed to present evidence connecting her to the address and failed to demonstrate that it was in the interest of justice to allow for late service of process.
